Heard on admission as the instant MCC has been preferred after 26 days of the order passed by this Court in WP No.1521 of 2002 dated 28-042017 whereby the said WP was dismissed for want of prosecution. 2.

On due consideration, the instant MCC is admitted for consideration. 3.

Learned counsel for the applicant would submit that as there was no representation on behalf of the respondents on 28-04-2017 when the matter was taken up for hearing, hence the instant MCC may also be heard even without noticing to the respondents.

On due consideration, heard the matter finally. 5.

The instant MCC is hereby allowed. WP No.1521 of 2002 dismissed for want of prosecution on 28-04-2017 is restored to its original number. 6.

No order as to cost.
