This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 04/2015, registered at Police Station G.R.P. Police Bilaspur, for the offence punishable under Section 20-B of NDPS Act.

After hearing learned counsel appearing for the parties and taking into consideration the nature and gravity of offence and quantity of Ganja i.e. 4 Kg. i.e. commercial quantity seized from the present applicant and taking into account the provisions contained in Section 37(1)(b) of the N.D.P.S. Act, this Court is not inclined to release the applicant on regular bail. 3.
Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected. However, trial Court is directed to expedite the trial and decide the case as early as possible.
