1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.267/2009 (ST No.20/2011 pending in the Court of Additional Sessions Judge, Raigarh), registered at Police Station Dharamjaigarh, Distt. Raigarh, for the offence punishable under Sections 302, 307, 294 and 341 read with Section 34 of the IPC.

2. This is the third bail application filed on behalf of the applicant for grant of regular bail.

3. Learned counsel for the applicant seeks to withdraw this application, at this stage, with liberty to repeat the prayer after examination of material prosecution witnesses.
