Hon'ble Shri Justice Gautam Chourdiya Order on Board 15/09/2021 1) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973 as he is in custody since 10/09/2020 in connection with Crime No. 110/2020 registered at Police Station Ramanujnagar, District Surajpur (C.G.) for the offence punishable under Sections 420, 409, 467, 468, 471 & 120B of the Indian Penal Code. 2) At the very outset, learned counsel appearing for the State submits that the bail applications of similarly situated co-accused Salman Ahamed Mansuri i.e. MCRC No. 6604/2020, Amosh Ekka i.e. MCRC No. 6615/2020, Amit Kumar Gupta i.e. MCRCA No. 1295/2020 & Abhishek Mandal i.e. MCRC No. 487/2021 have been rejected on merits by the Co-Ordinate Bench of this Court vide order dated 16/01/2021 & 18/06/2021 respectively and the bail application of other similarly situated co-accused Sachin Govindao Gaikwad @ Pappu has already been dismissed as withdrawn vide order dated 31/08/2021 passed by this Court in MCRC No. 3624/2021.

3) In view of above, learned Counsel for the applicant seeks to withdraw this application with liberty to file afresh as and when occasion arises.

4) Accordingly, the application is dismissed as withdrawn with the liberty as stated above.
