(2) Learned counsel appearing for the petitioner submits that the petitioner may be permitted to withdraw the instant writ petition with liberty to prefer an appeal before the appellate authority within a period of two weeks from today. (3) Prayer appears to be fair and reasonable.
(4) Accordingly, the petitioner is permitted to file an appeal before the appellate authority. If such appeal is filed by the petitioner before the appellate authority within a period of two weeks from today, the concerned authority shall consider and decide the same on its own merit and in accordance with law preferably within a period of three months from the date of receipt of appeal along with copy of this order.
(5) With the aforesaid observation, the petition stands finally disposed of. No order as to cost(s).
