The applicant has been arrested in connection with Crime No.414/2020 registered at Police Station - Kasdol, District - Baloda Bazar, Bhatapara (C.G.) for alleged commission of offences under Section 302, 201 of IPC.

This is repeat application for grant of bail. Earlier application was rejected by this Court mainly on the ground that one of the witnesses who is stated to be eye witness, has not supported the case of the prosecution and therefore, what is left, is recovery of shovel and club and the prosecution case, memorandum statement of the applicant, dead body was exhumed and recovered, therefore, at this stage, the applicant may be granted bail. 3.

Taking into consideration the submission of learned counsel for the parties and considering that apart from statement of eye witnesses, there are other incriminating circumstances that the dead body was exhumed from the spot stated by the applicant, I am not inclined to grant bail to the applicant.
