Learned counsel for the petitioners would submit that pursuant to order Annexure P-1, recovery proceeding is being initiated against the petitioners.

Learned counsel for the respondents would submit that the petitioners' appeal against the order dated 29/02/2016 is pending consideration before the appellate authority i.e. Chhattisgarh Rajya Sahkari Vipdan Sangh Maryadit, Raipur.

Since the appeal against the petitioners is pending consideration, the appellate authority is directed to do well

and decide the appeal expeditiously.

Learned counsel for the petitioners has brought to the notice of this Court the decision rendered in Writ Petition No. 2773/2003.

The appeal is pending consideration. If some proceedings of recovery are initiated against the petitioners, they are at liberty to make interim application before the appellate authority and the appellate authority would do well to decide the said application expeditiously in accordance with law.

With the aforesaid observation, the writ petitions stand finally disposed of. However, the petitioners are at liberty to approach the Court, if occasion arises. 7.

It is made clear that this Court has not expressed any opinion on the merits of the case.
