The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 274/2015 registered in Police Station Kawardha, District Kabirdham (C.G.) for offence punishable under section 457 of IPC.

As per the prosecution case, on 29/09/2015 the applicant was standing at the roof of the house of the complainant and when the complainant had caught hold of him and asked the reason, applicant could not explain the reason and thereafter report was made and the applicant was arrested on 30/09/2015.

Learned counsel for the applicant submits that applicant has been falsely implicated in this case and as per the allegation of the prosecution itself case would not be made out and offence is triable by JMFC, therefore applicant may be enlarged on bail.

Having regard to the gravity of the offence and charges which has been levelled against the applicant and considering the fact that applicant is in jail since 30/09/2015, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. Certified copy as per rules.
