Dharamraj @ Raja Satnami v. State Of Chhattisgarh
NAFR HIGH COURT OF CHHATTISGARH, BILASPUR Criminal Revision No.659 of 2018 Dharamraj @ Raja Satnami, S/o Shiv Satnami, aged about 28 years, R/o Village Domanpur, P.S. Pandariya, Tahsil Pandariya, Civil and Revenue District Kabirdham, Chhattisgarh ---- Applicant versus State of Chhattisgarh through P.S. Pandariya, Civil and Revenue District Kabirdham, Chhattisgarh --- Respondent For Applicant : Shri Dinesh Tiwari, Advocate For Respondent : Shri Satish Gupta, Govt. Advocate Hon'ble Shri Justice Arvind Singh Chandel Order on Board 26.6.2018 1.
Heard on admission. Also perused the material available with due care.
2.
This revision has been preferred against the order dated 9.5.2018 passed by the Additional Sessions Judge (FTC), Kabirdham in Sessions Trial No.94 of 2017, whereby the Additional Sessions Judge has rejected the application of the Applicant moved under Section 311 of the Code of Criminal Procedure. 3.
Learned Counsel appearing for the Applicant submits that earlier Shri Chand Khan, Advocate was the Counsel for the Applicant before the Trial Court, who cross-examined the prosecutrix, but, at the time of cross-examination, some material questions had not been put to the prosecutrix. Therefore, he prays that he may be afforded an opportunity to further cross-examine the prosecutrix. 4.
A bare perusal of the copy of the deposition-sheet of the
prosecutrix reveals that sufficient opportunity has been afforded to the defence for cross-examination of the prosecutrix. Therefore, the Trial Court has rightly rejected the application under Section 311 of the Code of Criminal Procedure.
5.
I find no merit in the instant revision. It is, therefore, dismissed in limine.
