This is first bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested on 21.04.2018 in connection with Crime No. 95/2018 registered at Police Station- Gole Bazar, Raipur, District- Raipur (C.G.), for the offence punishable under Sections 3, 4, 5 & 7 of the Immoral Traffic (Prevention) Act (PITA) and Section 4 (A) of Public Gambling Act. 2.

Case of the prosecution is that on being raid conducted in the hotel, the accused was caught hold by the police while gambling and thereby the aforesaid offence was committed.

Learned counsel for the applicant would submit that the applicant is innocent and trial will take sufficient time, the applicant is in jail since 21.04.2018 therefore, the applicant may be enlarged on bail. 4.

On the contrary, learned State counsel opposes the application for grant of bail.

Merit of the case will be dealt by the trial court. Looking to the facts and circumstances of the case, I am inclined to release the applicant on bail.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed and it is directed that the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs. 25,000/- with one local surety in the like amount to the satisfaction of the concerned trial Court. He shall appear before the trial court regularly on each and every date, unless exempted from appearance.
