Learned counsel for the petitioner would submit that pursuant to order Annexure P-1, recovery proceeding is being initiated against the petitioner.

Learned counsel for the respondents would submit that the petitioner's appeal against the order dated 29/02/2016 is pending consideration before the appellate authority i.e. Chhattisgarh Rajya Sahkari Vipdan Sangh Maryadit, Raipur.

Since the appeal against the petitioner is pending consideration, the appellate authority is directed to do well and decide the appeal expeditiously.

Learned counsel for the petitioner has brought to the notice of this Court the decision rendered in Writ Petition No. 2773/2003.

The appeal is pending consideration. If some proceedings of recovery are initiated against the petitioner, he is at liberty to make interim application before the appellate authority and the appellate authority would do well to decide the said application expeditiously in accordance with law.

With the aforesaid observation, the writ petition stands finally disposed of. However, the petitioner is at

liberty to approach the Court, if occasion arises. 7.

It is made clear that this Court has not expressed any opinion on the merits of the case.
