(2) Learned counsel appearing for the State submits that against the impugned order dated 05.06.2017 passed by

respondent No.3-Sub Divisional Magistrate (Revenue), Masturi, District Bilaspur is appealable before the Collector, Bilaspur. (3) At this stage, learned counsel appearing for the petitioner submits that the petitioner may be permitted to withdraw the instant writ petition with liberty to prefer an appeal before the Collector, Bilaspur within a period of 30 days from today. (4) The prayer appears to be fair and reasonable. (5) The writ petition is accordingly disposed of with a direction to the petitioner to prefer an appeal before the Collector, Bilaspur. If such appeal is filed by the petitioner within a period of 30 days from today and, in turn, the Collector, Bilaspur shall consider and decide the same in accordance with law, after affording proper opportunity of hearing to the parties expeditiously preferably within a period of four months from the date of receipt of certified copy of this order.
