1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.470/2018 registered in Police Station Ratanpur, District Bilaspur for offence under Sections 363, 366, 376 of the IPC and Section 4 & 6 of the Protection of Children from Sexual Offences Act, 2012.

2. The first bail application was dismissed as withdrawn with

MCRC No. 3456 of 2019 liberty to repeat the prayer for regular bail after examination of the prosecutrix. Now, the prosecutrix and her father have been examined before the trial Court on 13.06.2019.

3. The applicant has allegedly abducted the prosecutrix, who was aged about 17 years 4 months on the date of incident. Both of them resided together for about 3 months when she was recovered from applicant's possession.

4. Although the prosecutrix is less than 18 years of age yet considering that they had an affair and the material available in the case diary as well as the deposition would indicate that they are likely to get married, I am inclined to allow the application for grant of bail.

5. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
