1. Counsel for the petitioner submits that the default has since been removed. With the consent of the parties, the matter is finally heard and disposed off at motion stage.

2. The limited grievance which the petitioner has made in the present writ petition is that the person immediate junior to the petitioner belonging to the same category to which the petitioner belong have been granted promotion vide order dated 25.10.2018.

-23. He further submits that during the said period, there was no punishment order by virtue of which the promotion of petitioner could have withheld.

4. He further submits that there are still vacancies available with the department wherein the petitioner can be accommodated or granted promotion. He also makes a submission that he has made a representation in this regard to the Higher Authorities in the department but till date that has not been decided.

5. Given the limited fact, let the respondent No. 1 & 2 take into consideration the representation which the petitioner has made for seeking consideration for promotion to post of Assistant Director Agriculture from the post of Senior Agriculture Development Officer. Let the respondent No. 1 & 2 take an appropriate decision in this regard within a period of 4 months from the date of receipt of copy of this order and an intimation may be given to the petitioner.
