1. The challenge in the present writ petition is to the order Annexure P-3 dated 08.04.2019. The impugned order has been passed in the light of a decision rendered by this Court in WPS No. 567/19 decided on 28.01.2019.
2. The grievance of the petitioner is that the respondent authorities should not have rejected the representation of the petitioner rather should have convened a DPC for promotion of the petitioner from the post of Assistant Sub Inspector to Sub Inspector.
-23. Having gone through the order dated 28.01.2019 passed in WPS No. 567/19 it is reflected that this Court had only directed the respondents to consider and decide his representation. This Court while disposing of the said writ petition in very categorical term held that the petitioner could be considered for promotion in the subsequent DPC that would be held. This Court had not given any specific direction to the State for holding a DPC so far as the petitioner is concerned.
4. Now since the representation has been rejected, it does not mean that the claim of the petitioner stands rejected for promotion. The petitioner would be entitled for being considered for promotion from the post of Assistant Sub Inspector to Sub Inspector in the next DPC that would be convened subject to the petitioner fulfilling all other eligibility criteria for promotion.
5. With the aforesaid observation, the present writ petition stands disposed of expecting the authority concerned to hold a DPC at the earliest in accordance with the rules and regulations governing the service conditions of the petitioner.
