Claim of Petitioner in the present Writ Petition is for grant of Time Scale Pay and Super Time Scale Pay.

During the course of hearing, learned Govt. Advocate shares a document which shows that the Petitioner in the recent past vide Order dated 24.1.2020 was granted the benefit of Kramonnati, that is granting of next higher pay scale on account of Petitioner not being promoted for a requisite length of service. 3.
Further, perusal of pleading also reveals that Petitioner has still got about 10 years of service left with the Department and subject to Petitioner fulfilling the other requisite criteria, he could still be considered for grant of next Kramonnati as well.

Given the said facts and circumstances of the case, this Court is of the opinion that at this juncture no case is made out calling for any interference or issuance of any direction to Respondents. In the event, if the Petitioner is aggrieved by any rule which does not provide any promotional avenue to him, the only recourse available to him is to challenge the said rule or agitate it before the Rule Making authority who may consider and decide the same. 5.
