This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.119/20 registered at Police Station Suleha, District BalodabazarBhatapara (CG) for the offence punishable under Sections 376, 506, 34 of the IPC, Section 3(2) (v) (ka) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (in short "the Act, 1989") and Section 6 of the Protection of

MCRC No. 4980 of 2020 Children from Sexual Offences Act, 2012.

3. Learned counsel for the applicant prays for withdrawal of the bail application with liberty to prefer a duly constituted appeal under Section 14A of the Act, 1989.

4. The prayer is allowed.

5. The bail application is dismissed, as withdrawn with the aforesaid liberty granted in favour of the applicant.

6. The certified copy of the impugned order be returned to learned counsel for the applicant after retaining a photocopy of the same.
