Justice Vimla Singh Kapoor Order On Board 13/07/2021 At the outset, learned counsel for the appellant seeks to withdraw this appeal with liberty to take appropriate remedy for setting aside ex-parte judgment and decree of divorce.

Considering that at the very outset, before admission of this appeal, permission is being sought to withdraw the appeal as the appellant / wife wish to take appropriate proceedings before the Court below against ex-parte decree of divorce, we are inclined to permit counsel for the appellant to withdraw this appeal and also grant him liberty to take appropriate proceedings which are available under the law for setting aside ex-parte decree of divorce.

The appeal is accordingly dismissed as withdrawn with the liberty as aforesaid. Certified copy of the decree of divorce be returned to counsel for the appellant after retaining photo copy of the same.
