Versus

1. Shri R. N. Panda, General Manager, Steel Authority Of India, Bhilai Steel Plant, Ispat Bhawan, B.S.P. Bhilai, Tahsil And District Durg, Chhattisgarh, P.S. Bhilai Bhatthi.

2. Smt. G.M.V. Padmini Kumar, Deputy Manager, Incharge Of The Post Of Sahayak Prabandhak (Karmik-Gair Sankarya-2 Of The Office Of Bhilai Steel Plant, Bhilai, Steel Authority Of India Ltd.), Tahsil And District Durg, Chhattisgarh, P.S. Bhilai.

---Respondents For petitioner :

Shri Vinod Kumar Sharma, Advocate.

Hon'ble Shri Ajay Kumar Tripathi, Chief Justice Hon'ble Shri Justice P.Sam Koshy Order on Board Per Ajay Kumar Tripathi, Chief Justice 03/08/2018 1.

Heard.

2.

The petitioner since herself has chosen to refund and deposit the benefit of CPF and gratuity dues which was settled under the old scheme only on 06/03/2018, the respondent - Bhilai Steel Plant has extended the benefit by offering Permanent Account Number under EFBS scheme.

3.

The grievance of the petitioner is that, her prayer in the Writ Application was to extend the benefit from the date of application which is said to be 13/03/2014, therefore, the authorities while issuing Annexure-C/4 dated 24/03/2018 have committed contempt of the Division Bench order. 4.

We do not find such a direction having been issued by the Division Bench. Infact, the Division Bench had given an option to the petitioner that if she applies and carries out the requirements needed, then the respondents were bound to fulfill and extend the benefit within 90 days. 5.

Since, there is a delay on part of the petitioner herself in refunding the previous benefit, therefore, no contempt is made out in the light of the directions dated 04/05/2017 of the Division Bench. 6.

Thus, the instant Contempt Application is dismissed. Sd/- Sd/- (Ajay Kumar Tripathi) (P. Sam Koshy) Chief Justice Judge Sumit/Ved
