Hon'ble Smt. Justice Rajani Dubey Order On Board 21.01.2021

1. By this CrMP, the petitioner seeks modification of the order dated 07.02.2020 passed in MCRC No. 8495/2019 regarding the surety amount granted by the Hon'ble Court.

2. This Court while deciding MCRC No. 8495/2019, considered all the aspects of the matter and looking to the nature of the offence committed by the applicant granted the bail on her executing a personal bond for a sum of Rs. 50,000/- with one local surety.

3. Learned counsel for the petitioner submits that the matter is of legal aid committee of this Hon'ble Court and the applicant is a very poor lady, aged about 60 years, suffering from various diseases, she is unable to furnish local surety of Rs. 50,000/- before the trial Court and, therefore, she is in jail. He

further submits that the order dated 07.02.2020 passed in MCRC No. 8495/2019 may be modified and the surety amount may be reduced.

4. In view of the aforesaid facts and circumstances of the case, the order passed in MCRC No. 8495/2019 is modified and surety amount of Rs. 50,000/- is reduced to Rs. 15,000/-.

5. It is directed that the petitioner shall be released on bail on her executing a personal bond for a sum of Rs. 15,000/- with one local surety in the like sum to the satisfaction of the trial Court.

6. Accordingly, the CRMP is disposed of.
