Versus
1. State Of Chhattisgarh Through The Secretary, Department Of Transport, Mantralaya, Mahanadi Bhawan, Naya Raipur, Dist. Raipur (Chhattisgarh)
2. Regional Transport Officer Dhamtari (Chhattisgarh) ---- Respondents For Petitioner :
Mr. Sushil Dubey, Advocate.
For State :
Mr. Satish Gupta, Government Advocate on advance copy.
Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 25/02/2016 Heard.
1.
The petitioner has filed this petition aggrieved by incorrect details in the digital driving licence issued to him. 2.
Learned counsel for the petitioner submits that earlier when driving licence was issued to the petitioner vide Anneuxre P/1 valid up to 21st October, 2030, he was granted driving licnece to drive Motor cycle with gear as also Light Motor Vehicle. But when he applied for digital licence, discrepancy has crept in as it does not include the driving licence for LMV. He submits that his entitlement to get driving licence was earlier considered and driving licence was
issued. The issuance of digital licence is only toward digitalization policy and it should be strictly in accordance with driving licence already issued to the petitioner.
3.
Upon perusal of Annexure P/1, driving licence originally issued to the petitioner, the claim of the petitioner does not appear to be frivolous because it shows that the petitioner was granted driving licence both for Motor cycle with gear as also for Light Motor Vehicle. Therefore, in these circumstances, respondent No.2 should consider petitioner's application and modify digital licence at the earliest. Let it be done within 30 days from the date of receipt of copy of this order. While issuing new digital licence, the petitioner will have to deposit the earlier digital licence issued to him. 4.
With the aforesaid observations, the petition is disposed off. Sd/- (Manindra Mohan Shrivastava) Judge Rekha
