This writ petition has been preferred against the order of SubDivisional Officer (Revenue), Raigarh dated 15.11.2017 (Annexure - P/1), whereby the petitioner's name has been deleted from the revenue records. 2.

Learned counsel appearing for the petitioner would submit that the impugned order is unsustainable and bad in law and is in teeth of the decision rendered by this Court in Mohan Lal Sahu v. State of Chhattigarh & Others 1, decided on 30.01.2018.

Per contra, learned State counsel would submit that the order is appealable before the appellate authority.

I have heard learned counsel for the parties and perused the records with utmost circumspection.

Be that as it may, the petitioner is directed to file an appeal before the appellate authority against the said order and also to bring to the notice of the appellate authority the decision rendered by this Court in Mohan Lal WPC No. 3139 of 2017

Sahu (supra). If such an appeal is preferred by the petitioner then the appellate authority shall consider and decide the same expeditiously in accordance with law.

With the aforesaid observation, the writ petition stands finally disposed of with no order as to cost(s).
