Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 18/03/2016 Heard.

1.

The petitioner, by this petition, has challenged the transfer order dated 09.03.2016 on two grounds.

The first ground is that the petitioner is at the fag end of his service, he is going to retire in the month of June, 2017. The second ground is that the place where he has been transferred is a remote place and there is no proper connectivity.

As far as second ground of distance is concerned, that cannot be ground of interference in the matter of transfer in a transferable service. The first ground that the petitioner is at the fag end of his service, may requires some consideration. Let the State Government consider this prayer of the petitioner and take a decision within three weeks from the date of receipt of copy of this

order.

For a limited period of three weeks, the petitioner shall not be subjected to any coercive action in the matter of implementation of transfer.

5.

If the representation is not submitted by the petitioner before the State Government within a period of ten days from today, the interim order shall loose its efficacy.

6.
