Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 14.07.2017 (1) Learned counsel appearing for the petitioner would submit that on account of blast of gas cylinder, which kept in the shop of the petitioner by which he has suffered damages and his shop was totally damaged. Against that, he made a complaint before the respondent No.4-Tahsildar. The Tahsildar has passed the order and granted compensation of Rs.60,000/- to him against that, this writ petition under Article 226 of the Constitution of India has been filed by him for enhancement of compensation amount. He would further submit that as per policy of Respondent No.1-Hindustan Petroleum Corporation Limited, therefore, the petitioner is entitled to grant a compensation of

Rs.40,00,000/-.

(2) On the other hand, learned counsel appearing for the State would submit that respondent No.4-Tahsildar has already granted compensation of Rs.60,000/- to the petitioner on account of blast of gas cylinder.

(3) In view of above, the petitioner is permitted to file a representation before the respondents No.2 & 3 for redressal of his grievance. If such representation is filed by the petitioner before the respondents No.2 & 3 and in turn, the respondents No.2 & 3 shall consider and decide the same in accordance with law preferably within a period of 45 days from the date of receipt of certified copy of this order. (4) With the aforesaid observation, the writ petition stands finally disposed of. No order as to cost(s).
