Learned counsel for the petitioner submits that evidence has already commenced.

Perused the order dated 23/03/2018 wherein at para 12 of the order court has observed that prima facie case is made out under Section 409, 420/34 of IPC. It is observed that said finding shall not come in the way before the trial court while adjudicating the case on merits and the trial court shall be obliged to decide the case without being influenced by the order passed by the revisional court. Considering the progress in the trial, petitioner is given liberty to raise all the defence before the trial court during the course of trial.
