Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 17/06/2016 This contempt petition has been filed alleging willful disobedience of interim order passed by this Court on 04/05/2016 whereby this Court directed that the respondents shall not take any coercive / penal action against the petitioner.

Learned counsel for the petitioner submits that though initially when the interim order was passed, the authorities did not correctly appreciate the text and tenor of the order and issued a letter on 07/05/2016 (Annexure C/3). However, later on, this Court had clarified its order by another order dated 01/06/2016 clearly mentioning therein that the interim order does not allow the respondents to reject petitioner's application for participating in tender process on the ground that its registration has been suspended.

At this stage, considering that this Court has already clarified its earlier order vide order dated 01/06/2016 that rejecting petitioner's application for participating in tender process on the ground that its registration has been suspended would amount to coercive step, this contempt petition at this stage is
disposed off reserving liberty to the petitioner to revive, if the respondents act contrary to the order passed by this Court on 04/05/2016 clarified vide order dated 01/06/2016.
