1. The applicant has preferred this application for grant of anticipatory bail, as he apprehends his arrest in connection with Crime No.460/2020, registered at Police Station Punjipathara, District Raigarh, for offence punishable under Section 376 of the Indian Penal Code.
2. Applicant sexually exploited the prosecutrix on promise to marry and later on refused to marry her on the date fixed for marriage in a temple.
3. Learned counsel appearing for the State, per contra, would oppose the bail application.
4. Considering the nature of allegations, the present does not appear to be a fit case for exercise of power under Section 438 of the Cr.P.C.
5. Accordingly, the bail application is rejected. However, if the applicant surrenders and applies for regular bail, the same shall be considered and decided, in accordance with law and on its own merits, expeditiously.
