Hon'ble Shri Justice P. Sam Koshy Order on Board 19/07/2021

1. The petitioners herein are candidates who had applied for the post of Teacher (Physical Education). The petitioners having undergone the entire selection process arising out of the advertisement dated 09.03.2019 were found successful and meritorious and document verification and counseling of the petitioners have already been undergone. According to the petitioners, except for issuance of the formal order of appointment all other procedures have been complete, but the respondent authorities are not issuing the order of appointment which has led to the filing of the present writ petition.

2. At this juncture the counsel for the State referred to an order passed by this court in WPS No.3298 of 2021, decided on 06.07.2021 wherein in paragraph 5 this court has made the following observations:

"5. Given the facts and circumstances of the case and also taking note of the developments that have transpired in between so far as issuance of appointment orders to the other post to which the recruitment process were conducted from the same advertisement, the present writ petition as of now stands disposed of directing the respondents to take an appropriate decision in respect of issuance of the formal order of appointment and posting orders to the petitioners in accordance with law at the earliest preferably within a period of 60 days from the date of receipt of copy of this order."

-33. According to State counsel, in the event if the State authorities comply with the aforesaid directions, perhaps the grievance of the petitioners herein also would get redressed.

4. Given the said submissions by the State counsel, the writ petitions at this juncture stand disposed of in similar terms to the directions given by this court in WPS No.3298 of 2021 quoted in preceding paragraph. Let appropriate decision be taken taking into consideration the claim of the petitioners herein as well within the period specified in the order passed in WPS No.3298 of 2021.

5. With the aforesaid observations, all the writ petitions stand disposed of.
