1. When the matter is called for hearing, none present for the applicant. No representation is made. It is noticed that for number of occasions no one has represented the applicant.
2. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.10/2015, registered at Police Station Kelhari, Distt. Koria, for the offence punishable under Section 20(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985 and Section 39/192 of the Chhattisgarh Motor Vehicles Act.
3. This is the first bail application filed on behalf of the applicant for grant of regular bail.
4. As per case of the prosecution, 3 quintals 7 Kgs. of Ganja was recovered from the possession of the applicant.
5. I have heard learned State counsel.
6. Taking into consideration the quantity of Ganja and the provisions contained in Section 37(1)(b) of the NDPS Act, I do not find any good ground to entertain the bail application. Accordingly, the application is rejected.
