1. Heard.

2. The applicant has preferred this application under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.86/2020 registered in Police Station Jashpur, Dist. Jashpur C.G for the offence punishable under Sections 294, 323, 506, 302 of the I.P.C.

3. Case of the prosecution, in brief, is that the applicant has committed murder of deceased - Samima Khatun at about

MCRC No. 5006 of 2020 3:00 pm on 13.04.2020 for which the FIR was lodged on the same day.

4. The incident was witnessed by Md. Sazid Khan. The case diary statement was read by learned State counsel.

5. Considering the statement of the eye witness, this Court is not inclined to release the applicant on bail at this stage.

6. Accordingly, the bail application is rejected. However, liberty is reserved in favour of the applicant to revive the prayer after examination of the eye witness.
