With the consent of the learned counsel for the parties, the matter is heard finally.

This review petition is directed against the order passed on 09.01.2012 in W.P. (S) No.70/2012, wherein this Court set aside the order passed by the State Government refusing to consider petitioner's application for grant of compassionate appointment.

The petitioner's father was a Permanent Gangman in Sub Division No.1, PWD, Rajnandgaon. This Court decided the matter on the basis of order passed by the Coordinate Single Bench in the matter of Smt.

Puna Bai vs. The State of Chhattisgarh and others in W.P. (S) No.4480/2006. At that time, Writ Appeal No.105/2012 preferred by the State challenging the order passed in Puna Bai (supra) was under consideration.

This review petition has been filed on the ground that it could not be brought to the notice of this Court, at the time of hearing, that the order passed in Puna Bai (supra) is challenged in appeal before the Division Bench.

Admittedly, the order passed in Puna Bai (supra) has been affirmed by the Division Bench vide order dated 27.04.2012 in W.A. No.105/2012. 6.

In view of the above, nothing survives in this review petition because, the law has been settled by the Division Bench. 7.

Accordingly, the review petition is dismissed. JUDGE Nirala
