Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 05/08/2016 The transfer order has been challenged on the ground that while transferring the petitioner, the policy of posting the husband and wife together at a place or at nearby station, subject to administrative exigency, has not been kept in view.

Learned counsel for the petitioner submits that the petitioner is posted at Kondagaon and his wife is working in Government School in block -Makdi, District - Kondagaon which is only 15 kms. away. It is submitted that now, by impugned transfer order, the petitioner has been transferred to Narayanpur, from where, the place of posting of his wife is about 85 kms. 3.

It is found that though the wife of the petitioner has not been posted at the place of posting of the petitioner, she is posted at a nearby station. In these circumstances, the respondent authorities may consider the case of the petitioner as to whether the petitioner and his wife can be adjusted at a nearby station.

It is found that no representation has been preferred by the petitioner. 5.

In these circumstances, this petition is disposed off with a direction to the petitioner to prefer representation within 10 days from the date of receipt of copy of this order which shall be decided by the authorities within a period of three weeks.
