Agrawal Order On Board 20/07/2017 (1) Learned counsel appearing for the petitioner would submit that the trial Court has rejected the petitioner's application/objection of document dated 28.03.2012, which is agreement to sell against which, this writ petition under Article 227 of the Constitution of India has been filed by the petitioner herein.
(2) I have heard learned counsel for the parties. (3) The trial Court has held that such an application/objection can be raised by the petitioner/defendant during the course of evidence. (4) Be that as it may, the petitioner is at liberty to raise an objection
during the course of trial. The trial court is directed to consider the objection of the petitioner, if raised during the course of trial without being influenced by observation made in the impugned order dated 15.05.2017.
(5) With the aforesaid observation, the writ petition stands finally disposed of.
