Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 09/08/2016 The transfer order is sought to be challenged on the ground that the petitioner is being transferred at the fag end of his service; wife of the petitioner is suffering from Arthritis problem; daughter of the petitioner is studying in B.Com 3 rd year.

The benefit of posting in the home district or at a place of his option is available as per circular dated 11/06/2016 only when he has left one year of service before retirement. Apparently, the petitioner has about two years left for his retirement. Therefore, that benefit is not available to the petitioner. The other two grounds are essentially the matters of personal difficulties which can be considered on administrative side and not a matter for consideration for the Writ Court.

Such matters can always be raised by the petitioner by way of preferring representation to the competent authority as provided under the transfer policy referred to above.

The petitioner has submitted representation to the Joint Director through proper channel. The representation be forwarded to the competent authority and the competent authority shall decide the same within a period of four weeks. 5.
