1. The limited relief, which the petitioner has sought for in the present writ petition is for a direction to the respondents No. 2 & 3 to ensure that the entire retiral dues payable to the petitioner is released at the earliest. In addition, there is also certain claims put forth by the petitioner while he was in service which also has not been finalized by the Department.

2. The petitioner further submits that there is also no departmental enquiry or charge-sheet pending against him, neither is he facing any sort of prosecution before any forum, by which the dues could have been retained/withheld temporarily.

Given the nature of dispute that the petitioner has made, this Court is of the opinion that ends of justice would serve if the respondents No.2 & 3 are directed to consider the claim of the petitioner so far as the release of the retiral dues are concerned, including 100% of pension as compared to the interim pension that he is being presently paid.

4. Let the respondents No.2 & 3 take a decision so far as the claim of the retiral dues and other bills that the petitioner has raised and in case if it is found that the bills and the retiral dues are payable to the petitioner and that there is no embargo so far as the releasing of the same, the respondents No.2 & 3 should ensure release of the same at the earliest preferably within a period of 4 months from the date of receipt of the copy of this order.
