Hon'ble Shri Justice Goutam Bhaduri Order 06/08/2019 Heard.

1. Learned counsel for the petitioner submits that the petitioner has successfully supplied the goods for which respondent has received the amount and bill were also verified to be correct for payment to be made to the petitioner, however despite frequent follow up amount was not paid and it amounts to deposit in their account. Learned counsel submits that the petitioner has made several representation time and again, same may be directed to be decided by respondent No.3.

2. After perusal of the documents, it is observed that if the petitioner have made supply and there is no dispute about supply so made qua the amount to be received, then in such case why the petitioner's amount was kept in deposit. Considering the prayer made by the petitioner, it is directed that respondent No.3 shall decide the representation made by the petitioner within a further period of 45 days with respect to his claim of the goods supplied.
