2. Mr. Bajpai accepts notice for respondents. With this applicant is not required to pay separate PF.

3. Heard on I.A. No. 1/2017 for condonation of delay as instant MCC has been preferred after 126 days of the order passed in WPS No. 3143/2015 dated 17-3-2017.

4. On due consideration, this court is of the considered view that the applicant has satisfactorily explained the cause of delay in preferring the MCC after 126 days from the order passed in writ petition.

5. Wit this I.A. No. 1/2017 is allowed.

6. Heard. MCC is admitted for consideration.

7. Heard the matter finally.

8. On due consideration, instant MCC is hereby allowed. WPS No. 3143/2015 dismissed for non-prosecution on 17-3-2017 is restored to its original number.

9. No order as to costs.
