Learned counsel for the petitioner submits that as against various supply of electric goods, supplied by the petitioner to respondent No.2 on supply orders, outstanding payments are not being released and respondent authorities are not responding to petitioner's claim either by paying the amount or by rejecting the same.

Learned counsel for the respondent Railway submits that the petitioner may submit fresh representation to respondent No.2, who shall examine the claim of the petitioner and take appropriate decision on the claim of the petitioner.

In view of the above, at this stage, instead of keeping this

matter pending, it would be expedient in the interest of justice to dispose off this petition with a direction to respondent No.2 to decide petitioner's claim within a period of three months from the date of receipt of fresh representation. The respondent No.2 shall pass speaking order on the claim of the petitioner. If upon scrutiny, the amount, if any, is found payable to the petitioner, the same shall be paid to the petitioner.

The reason for non-payment, if any, shall be clearly spelt out in order deciding petitioner's representation. Thereafter, if the cause of action survives, the petitioner shall be at liberty to approach appropriate Forum for redressal of his grievance. Sd/- (Manindra Mohan Shrivastava) J U D G E Rekha
