This is the first bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.147/2020, registered at Police Station Civil Lines, District Raipur(CG) for the offence punishable under Sections 419, 420, 467, 468, 471, 120 B, 34 of the IPC.

As per the case of prosecution, the complainant lodged a report that the applicant along with other co-accused persons had obtained loan of Rs. 1,20,00000/- from the Union Bank of India, Branch Shankar Nagar, by submitting forged documents of Registry of land. It is alleged that the photograph of the present applicant has been used in obtaining the loan.

Learned counsel for the applicant submits that the applicant has not committed any offence and she has been falsely implicated in the crime. He submits that the applicant is not at all involved in the case and her photograph has been used by someone. He further submits that the co-accused have been released on bail by this Court in MCRC4977/2020, 2517/2020, 2797/2020. He submits that the applicant is in jail since 3.6.2020 and trial is likely to take some time for its final disposal, therefore, the applicant may be released on bail. 5.

On the other hand, learned counsel for the State opposes the bail application.

Perused the entire material available on record. 7.

Considering the facts and circumstances of the case, in particular the nature of allegations against the applicant; the co-accused have been released on bail; yet charge sheet has not been filed; the applicant is a lady and trial may take some time for its final disposal, without commenting on merits, I am of the opinion that present is a fit case to release the applicant on bail.

Accordingly, the bail application filed under Section 439 Cr.P.C. is allowed.

It is directed that the applicant shall be released on bail on her furnishing a personal bond in sum of Rs.50,000/- with one surety in like sum to the satisfaction of the concerned trial

Court for her appearance before the said Court as and when directed till the disposal of the trial.
