1. Heard.

2. The grievance of the petitioner is that the petitioner was initially appointed as Shiksha Karmi Grade-III on 26.09.2008. Thereafter, he was appointed on the post of Shiksha Karmi Grade-II on 02.01.2009 and subsequently, he was appointed on the post of Shiksha Karmi Grade-I on 07.06.2010 and presently he is posted as Lecturer (LB) at Government Higher Secondary School, Kosmandi, Tahsil Palari, District Baloda Bazar-Bhatapara.

It is stated that as per the circular of the State after completion of 8 years of service, the petitioner is entitled to get the benefit of revised pay scale as his length of service is required to be counted from the date of initial appointment even on the lower post. However, the said benefit has not been given to the petitioner despite the order passed by this Court in the case of Mukesh Kumar Patel & anr. Vs. State of Chhattisgarh & anr. (WPS No.2530 of 2017) and other connected matters. Therefore, learned counsel for the petitioner prays that at this stage, the petitioner may be given liberty to make representation before the respondent No.5 and the respondent No.5 may be directed to decide the same according to the law laid down by this Court in the case of Mukesh Kumar Patel (supra).

Considering the limited prayer made by the petitioner, the petitioner is given liberty to make representation before the respondent No.5 within a period of three weeks from today and the respondent No.5 shall decide the same within a further period of 90 days from the date of receipt of the representation keeping in view the the period

of service rendered by the petitioner and if the petitioner is entitled to get the revised pay scale as per the length of service rendered by him, the same may be allowed, subject to the verification of the facts.
