Hon'ble Vacation Judge 23/05/2018

1. Learned counsel for the petitioner would submit that the petitioner Bank has suffered an order of eviction from the Rent Controlling Authority, Mungeli on 06.12.2017. Since the Bank does not intend to challenge the said order in appeal, the petitioner needs sometime to make an alternative arrangement for which Bank moved an application before the landlord with a copy to the Rent Controlling Authority, but the execution proceedings are going on and the belongings of the Branch can be thrown out at any point of time.

2. Considering the statement that the Bank does not intend to prefer an appeal against the eviction order and it needs only three months time to vacate the premises, ends of justice would be served, if the bank is allowed three months time to vacate the premises. The Bank shall submit an undertaking before the Rent Controlling Authority within a week from today stating that the premises shall be vacated on or before 24th August, 2018.Till then the petitioner shall not be evicted from the premises.
