Hon'ble Shri Justice Manindra Mohan Shrivastava Order on Board 02/05/2016 Learned counsel for the applicant submits that application for condonation of delay has been filed, address of respondent No.3 has also been provided and certified copy of the order has also been filed.

The submission are taken on record.

Also heard on application for condonation of delay in filing MCC.

The period of delay is stated to be 390 days and explanation has also been offered. The present case arises out of an order of dismissal of the case for non-compliance of the order passed by this Court.

Considering the aforesaid circumstance, delay in filing restoration application is condoned.

For the reasons stated, automatic dismissal of the petition is recalled and the petition [WP(S) No.7682 of 2011] is restored to its original number.
