Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 12/04/2016 Heard on admission.

The petitioners have filed this petition aggrieved by the decision of the respondent in holding examination of Class 10th and Class 12th under Directorate of

Open School Education, Chhattisgarh at Govt. Higher Secondary School, Kusmi for students registered at Education Centre, Samri. 2.

Learned counsel for the petitioners submits that petitioners and other large number of students, 792 in number, are registered with education centre at Samri. The respondent / Directorate of Open School is conducting annual examination and for that purpose, examination centre at Kusmi has been fixed which is about 50 to 60 kms away from Samri. Learned counsel for the petitioner submits that this will cause inconvenience and difficulty to the petitioners and other students who have to appear in the examination at Kusmi. It is also submitted that earlier, examination centre was fixed at Samri but for undisclosed reason, centre has been changed and fixed at Kusmi..

3.

Learned counsel for respondent No.2 upon instructions submits that the distance from Samri to Kusmi is not as much, as stated by the petitioner. It is submitted that examination of class 12 has already commenced today and for class 10, examination is to commence from 18/04/16. He also submits that there may be some inconvenience to the students who appear in the examination but centres are fixed taking into consideration various administrative reasons and at this stage, if any alteration takes place, there will be serious difficulty in managing examination in proposed place.

4.

It is not a case that examination centre has been changed at the eleventh hour. There may be some difficulty for the students to go to the centre at Kusmi however, considering that examination of class 12 has started today and for class 10, is commencing on 18/04/16, I am not inclined to interfere with the administrative decision in fixing examination centres. The petition is accordingly dismissed.
