ORDER

Mr. Dheerendra Pandey, learned counsel for the applicants seeks permission of this Court to withdraw the bail application. However, he submits that as applicant no. 1 is an elected Sarpanch and applicant no. 2 is a Secretary of village Panchayat, hence, a direction may be issued to the Court below concerned considering the bail application for grant of regular bail, if filed by applicants after their surrender, on same day.

Learned State counsel submits that he is having no objection to the submission made by learned counsel for the applicants. 3.

Accordingly, bail application is dismissed as withdrawn. In the event, applicants, after their surrender, file application for grant of regular bail, learned Court below may consider and decide the bail application on same day, if possible, in accordance with law.
