While entertaining this petition on 25.08.2017, this Court passed the following order:- "Taking into consideration that the petitioner, a confirm and permanent Assistant Professor in the Institution, has been dismissed without holding departmental enquiry, charge sheet and any order holding petitioner's guilty of any misconduct, it is directed that the effect and operation of the impugned order shall remain stayed till the next date of hearing."

The respondents would appear and submit that infact a departmental enquiry has been conducted, wherein the petitioner was provided proper opportunity and finding of guilt has also been recorded.

In view of the above, let the petitioner avail alternative remedy of statutory appeal under Statute No.32-3 of the College Code within a period of one month from today. The appeal shall be considered and decided objectively by a reasoned order within a further period of 6 months.

Since this Court has allowed interim relief to the petitioner, the same shall continue only for a period of 6 months. 5.

The parties are expected to cooperate for disposal of the appeal within the time allowed by this Court.

Accordingly, the writ petition is disposed of with the aforesaid observation.
