1. The present batch of writ petitions have been preferred by the legal heirs of the deceased employee for grant of compassionate appointment or for consideration of their cases on the ground that they are dependents of the deceased employees who were working with the erstwhile MP Electricity Board (for short 'MPEB') and at the time of death were posted in the area falling within the territorial jurisdiction of the present State of Chhattisgarh. In all the cases, the concerned employee died in harness on or after 30.1.1997, which is not disputed by the respondents.
2. The applications filed by the petitioners either soon after the death of the employees or at a later period were either rejected or not considered on the ground that since the Chhattisgarh State Electricity Board came to be
constituted on 15.11.2000, it shall not consider the cases of compassionate appointment wherein the death has taken place prior to the said date. WP No.1736/2004 was filed by one such similarly placed petitioner whose claim was rejected by the Chhattisgarh State Electricity Board (henceforth 'CSEB'). In the said petition, decided on 6.7.2006, the Single Bench of this Court directed the CSEB to consider the case of the petitioner for compassionate appointment in accordance with policy dated 30.1.1997, which was prevalent at the time of death of the employee. This order of the Single Bench was challenged before the Supreme Court by the CSEB by filing SLP (Civil) No.19197/2006. The Supreme Court vide order dated 26.8.2014 dismissed the SLP and directed that CSEB may consider the applications of the respondents for appointment on compassionate ground within a period of 3 months from that day.

After the said judgment of the Supreme Court, all other writ petitions pending before this Court came to be disposed of by a common order dated 18.12.2014 passed in Writ Petition No.2952/2006 {Om Prakash Thakur Vs. Chhattisgarh State Power Distribution Company Ltd. & others} & other connected matters. Thereafter in a petition filed in the year 2014 bearing WP(S) No.6476/2014 {Dhiraj Kumar Vs. State of Chhattisgarh & others}, this Court again passed an order on 28.1.2015 in the following manner:- "03. Counsel for the parties fairly submit that number of identical petitions {W.P. No.2952/2006, Om Prakash Thakur Vs. CG State Power Distribution Company Ltd. & others, and other connected petitions} have been decided by this Court on 18.12.2014 and therefore, the present petition may also be disposed of in the light of the said order.
04. In view of the above, the present petition is disposed of with a direction to the petitioner to file fresh application/ representation/reminder along with all the necessary documents before Manager, HRD, Chhattisgarh State Power Holding Company Ltd., office at Dangania, Distt.
Raipur (CG) giving reference of his earlier applications within two months from today. In the eventuality of filing such application, the respondent/Company may decide the same as per the policy in vogue in accordance with law as expeditiously as possible preferably within four months from the date of receipt of the application. The respondents while deciding the application would be at liberty to strictly apply the eligibility conditions laid down in the policy dated 30.1.1997."
4. In yet another petition viz. Writ Petition No.4880/2004, different coordinate Bench passed an order on 26.2.2015 directing consideration of the case of the petitioner in accordance with the policy dated 30.1.1997.
5. Shri Gaharwar, learned counsel for the respondents would refer to the judgments of the Supreme Court in the matters of Haryana State Electricity Board and another Vs. Hakim Singh1, Union of India and others Vs. Bhagwan Singh2, Jagdish Prasad Vs. State of Bihar and another3, R.R. Kulasekharan Vs. A.P.P.S. Commission and others4, State of U.P. and others Vs. appointments could be given only against the vacant sanctioned post to be notified for recruitment and not in any other manner or by creating the post for making compassionate appointment. He would further submit that in many cases, the applications have been moved after attaining the majority or the matters having become stale because of efflux of time. He would also submit that copies of the applications claimed to be filed by the petitioners are yet to be verified and it is apprehended that copies annexed with the writ petitions may not have been submitted. He would further submit that prior to 15.11.2000 the affairs of the CSEB or successor companies were under the control of erstwhile MPEB.
6. The cases filed from the year 2003 to 2006 have been disposed of by this Court by passing a common order in the case of Om Prakash Thakur (Supra). In another writ petition filed in the year 2014 bearing WP(S) No.6476/2014 also, this Court relied upon the order passed in Om Prakash Thakur (Supra) to dispose of the writ petition in the manner reproduced in para-3 above. In the said case i.e. WP(S) No.6476/2014, this Court has recorded joint submission by learned counsel appearing for both the parties for passing similar order as has been passed in the matter of Om Prakash Thakur (Supra). Thus, the respondents having agreed for a similar order, in the petition filed in the year 2014 decided on 28.1.2015, it would be appropriate for this Bench also to pass similar order so as to maintain parity and judicial comity, as held by the Supreme Court in the matter of World Sport Group (Mauritius) Ltd. Vs. MSM Satellite (Singapore) Pte. Ltd.12.
7. At this stage, Shri Gaharwar, learned counsel for the respondents would refer to the Division Bench order passed on 10.11.2014 in the matter of Tamradhwaj Verma Vs. State of Chhattisgarh and others {WA No.588/2013} 12 AIR 2014 SUPREME COURT 968
to put forth his submission that the claim based on policy dated 30.1.1997 has been negatived by the Division Bench, therefore, the present batch of writ petitions also deserves to be dismissed.
8. This Court has gone through the record of WP(S) No.5526/2007 out of which the said appeal of Tamradhwaj Verma arose. In the said case, claim for compassionate appointment was rejected and thereafter the writ petition was also dismissed by the Single Bench. The Single Bench as well as the Division Bench has dealt with the merits of the case and having considered the provisions of the policy dated 30.1.1997 concluded that the petitioner's claim for compassionate appointment has rightly been refused. Thus, the said matter was dealt with on merits whereas in the present cases, claims of the petitioners have been dismissed or not considered on the ground that their cases are not covered with the policy dated 30.1.1997. Thus, the stage at which consideration was made is entirely different.

For the foregoing, the present batch of writ petitions is disposed of in the following manner:- • The petitioners shall submit fresh representations within a period of one month, along with copies of the earlier applications filed by each of them and supporting documents before the Manager, HRD, Chhattisgarh State Power Holding Company Limited, Dangania, District Raipur.
• On such representations being filed, the respondents shall decide the same strictly in accordance with the policy dated 30.1.1997. • It is made clear that while deciding the representations, the respondents would be at liberty to take into consideration the law laid down by the Supreme Court in various decisions as also the law laid down by the Division Bench of this Court in WA No.588/2013.
10.However, it is made clear that this Court has not expressed any opinion on the merits of the case and the respondents shall decide the representations in accordance with the policy dated 30.1.1997 and the principles governing grant of compassionate appointment laid down by the Supreme Court and the Division Bench of this Court and nothing contained in this order shall be construed as any opinion on merits in favour of the petitioners.
