Taking into consideration the ground urged in the application, I am inclined to condone the delay. Accordingly, the application is allowed and the delay in filing the MCC is hereby condoned.

Taking into consideration the ground urged in the application and the circumstances, in which, the petition was dismissed for want of prosecution, I am inclined to recall the order passed by this Court on 10-12-2013 in Writ Petition No.1152/2003 to grant the petitioner an opportunity to contest the matter on merits. 5.

Accordingly, the aforestated order of dismissal passed earlier for want of prosecution is hereby recalled and the writ petition is restored to its original number and be listed.
