Learned counsel for the petitioner submits that despite a direction given by this Court on 17/06/2014 in WPC No.169/14, till date, proceedings under show cause notice dated 02/08/2014 have not been finalised. 2.

Submission of learned counsel for the petitioner is that non-finalisation of the proceedings for more than 11⁄2 years amounts to willful disobedience of the directions of this Court.

I am afraid, submission of learned counsel for the petitioner is without any substance. WPC No.169/14 was filed by one Haji Mohd. Iliyas and other office bearers.

Merely because, the proceedings have not been concluded till date, without anything more, it cannot be said that it is an act of willful disobedience of order dated 17/06/2014. It needs to be noted that in that petition, the order was set aside with liberty to the Waqf Board to take action by giving

opportunity of hearing to Haji Mohd. Iliyas and nothing more, much less any time bound direction for completion of any proceedings. 4.
