Hon'ble Mr. Justice Parth Prateem Sahu Order On Board 04/8/2021

1. Learned counsel for the petitioner submits that pursuant to advertisement dated 9.3.2019 issued by respondent No.2, the petitioner has applied for the post of Teacher (Physical Education). After completion of selection process, the petitioner was called upon to submit his documents for verification, which he submitted. The Joint Director, Education

Division, Raipur after verification found the documents submitted by the petitioner to be correct and acceptable. However, till date appointment order has not been issued in favour of petitioner. He further submits that other similarly situated persons have also approached this Court by filing writ petition raising similar grievance as is being raised in present petition, which came to be registered as WPS No.3298/2021. This Court vide order dated 6.7.2021 disposed of said writ petition directing respondent State authority concerned to complete process of appointment at the earliest preferably within a period of sixty days from the date of receipt of order. He submits that present petition may also be disposed of in terms of order dated 6.7.2021 (Annexure P-6) passed by this Court in WPS No.3298/2021.

Mr. Jitendra Pali, learned Deputy Advocate General for the State submits that after issuance of order dated 22.1.2021, on account of closure of schools due to spread of pandemic Covid-19, the appointment proceedings could not be completed. He submits that he has no objection if this petition is disposed of in terms of the order dated 6.7.2021 passed in WPS No.3298/2021.

3. I have heard learned counsel for the parties.

4. Taking into consideration the facts and circumstances of case, submissions made by learned counsel for both sides and the fact that selection process initiated pursuant to advertisement

dated 9.3.2019 is still not completed, the respondent State authorities are directed to conclude selection/appointment process commenced based on advertisement dated 9.3.2019 at the earliest, preferably within a period of sixty days from the date of receipt of certified copy of this order, in accordance with law.
