The challenge in the present writ petition was to the order of termination dated 10.06.2019 (Annexure P/1). It was also the contention of the petitioner that subsequent to the order of termination having being passed the petitioner had preferred an appeal before the respondent No.3 i.e. the Appellate Authority

under the regulations governing the service conditions of the petitioner. However, according to the petitioner, till the time the writ petition was filed, the appeal was not decided. 2.

Today when the matter is taken up for hearing, the learned counsel appearing for the respondents under instructions of Mr. Baghel, Advocate submits that it has been informed that the departmental appeal preferred by the petitioner has already been decided on 25.10.2019. The counsel for the petitioner at this juncture submits that he has not been served with any of the order in respect of the decision taken by the Appellate Authority, nor has he been ever communicated of the same.

Given the said submission by the counsel on either side, this Court is of the opinion that in the light of the statement made by the counsel for the respondents the present writ petition at this juncture can be disposed of with a direction to the respondents in ensuring that the order passed on 25.10.2019 is served upon the petitioner within a period of 7 days. The respondents are directed to send the copy of the Appellate Authority's order at the address given in the cause title of the present writ petition, so far as the address of the petitioner is concerned, instead of the address that is reflected in the service records. In addition the service of the order can also be effected by Whatsapp, E-mail or whatever mode, which the petitioner may avail in addition to the same being sent to the petitioner by post.

The petitioner would also be at liberty to take appropriate recourse available to him challenging the subsequent development which includes filing of a fresh writ petition.

With the aforesaid observations, the present writ petition stands disposed of.
